TUPE Law – individuals
If your employer is selling the business, loses a tender to a new contractor or is thinking of outsourcing and this affects you, you have rights which protect you.
The Transfer of Undertakings (Protection of Employment) Regulations 2006 (or TUPE for short) are likely to apply to you. This means that your employment should transfer, with your continuous service unaffected. It also means that detrimental changes to your terms and conditions of employment should not be made by your new employer. There are only limited grounds on which you could be dismissed either prior to or after a TUPE transfer. TUPE law is complex, but is designed to protect you.
If you are concerned about your position or feel that you have been unfairly treated, or dismissed, as a consequence of a business sale, tender or outsourcing situation, you should contact our team of employment law specialists in Ipswich, Suffolk. We can tell you what your rights are under TUPE and if you have not been treated well, how you can respond to this. If you need to bring a claim, we can advise and represent you to ensure that you achieve the best outcome.
As with everything we do, our charges are very reasonable and tailored to the work that you would like us to do.
