Redundancy advice – individuals

Employers are allowed to restructure and re-organise their businesses. This can lead to a redundancy situation. We understand that a redundancy situation is one of the most stressful experiences that you can encounter at work.  You need to know what your rights are in a redundancy situation.  Gotelee Solicitors’ team of specialist employment lawyers in Ipswich, Suffolk will help you, if you are facing redundancy.

Redundancy situations can arise if your whole site is going to be closed, or your department is going to be shut.  There may have be a downturn in work, or technology may be replacing people’s jobs.  In other cases, you might believe that redundancy is being used as a convenient reason to get rid of you, especially if you are the only person affected.

If there is a true redundancy situation, your employer must follow a fair procedure.  This involves consultation with you (and representatives, if more than 20 employees are at risk).  Selection processes have to be fair and reasonable.  Alternatives to avoid compulsory redundancy have to be considered.  If there are alternative jobs, these have to be considered with you. If this process is not followed, this is likely to mean that your dismissal was unfair.  You could be entitled to compensation over and above any redundancy payments that you are offered.

We will be able to help you if you find yourself in this unfortunate position.  Gotelee Solicitors’ team of employment Solicitors in Ipswich, Suffolk have years of experience on the right and wrong ways to deal with a redundancy situation.  If you have been unfairly treated, we can advise you on your options, including negotiating a better package or representing you in any claims that you need to bring to protect yourself, including unfair dismissal and for a statutory redundancy payment.
