Business Transfers and TUPE

If your employer is selling the business, loses a tender to a new contractor or is thinking of outsourcing and this affects you, you have rights which protect you.

The Transfer of Undertaking (Protection of Employment) Regulations 2006 (or TUPE for short) are likely to apply to you. This means that your employment should transfer, with your continuous service unaffected.  It also means that detrimental changes to your terms and conditions of employment should not be made by your new employer.  There are only limited grounds on which you could be dismissed either prior to or after a transfer of your employment. The rules are complex, but they are designed to protect you.

How we can help

If you are concerned about your position or feel that you have been unfairly treated as a consequence of a business sale, tender or outsourcing situation, you should contact our team of employment solicitors.  We can tell you what your rights are and if you have not been treated well, how you can respond to this.  If you need to bring a claim, we can advise and represent you to ensure that you achieve the best outcome.

Our charges

As with everything we do, our charges are very reasonable and tailored to the work that you would like us to do.  In the vast majority of cases, we will agree a fixed fee for your work, so that you have comfort in knowing that you can safely budget, with no fear of receiving an unexpected bill from us.
