Redundancy

Employers are entitled to restructure and reorganise their business and sometimes this can result in a redundancy situation.  Being placed at risk of redundancy, with the prospect of possibly losing your job is one of the most stressful experiences that you could encounter at work.   You will ordinarily have a number of rights in any redundancy situation.  Gotelee’s team of specialist employment solicitors will help you, if you are unfairly made redundant.

Sometimes it will be obvious that there is a true redundancy situation – your whole site might be closed, or your department disbanded.  There may have been a downturn in work, or technology may be reducing the need for certain work to be carried out by you.  In other cases, you might suspect that redundancy is being used as a convenient reason to get rid of you, especially if you are the only person affected. 

If there is a true redundancy situation, your employer has to follow a fair procedure.  This involves proper consultation with you (and representatives, if more than 20 employees are at risk).  Selection processes have to be fair and objective.  Alternatives to avoid compulsory redundancy have to be considered.  Suitable alternative jobs have to be considered with you. If this process is not undertaken fairly, this is likely to mean that your dismissal was unfair.  You could be entitled to compensation over and above any redundancy payments that you receive.
