Can you claim compensation after a back injury at work?

The personal injury team at Gotelee were contacted by a client because they had suffered a back injury in an accident at work. The injury had gone on to develop into chronic pain and impact on the client’s quality of life.

Howard Bush, an Associate at Gotelee, met with the client and established that there was a potential ‘no win, no fee’ case. Howard then went on to assist by obtaining an admission of liability for the accident from the employer’s insurers. It was important for the client to get some treatment and the next step was for Gotelee to obtain an interim payment to arrange for this. Medical evidence showing that the injuries had been caused by the accident along with evidence to support other losses that the client had incurred was gathered and then served on the opponent and a date for a trial was set.

As is often the case, shortly before trial date the parties met and Howard was able to negotiate a settlement in excess of £300,000.00. A settlement figure like will take into account the need for ongoing care and loss of earnings for example. “When representing clients in cases such as this we always have to think about the lifetime of our client, the losses they have incurred as a result of the accident and their future needs. Too often, the media create headlines with large numbers without the detail behind them which is misleading,” explained Howard.
