Mediation is a form of Alternative Dispute Resolution. A mediation is a settlement negotiation, which is facilitated by a Mediator. The Mediator’s job is not to decide the case – they are not a Judge. A good Mediator will work with the parties to reach a negotiated settlement.
Mediation is flexible both in terms of its procedure and the remedies that can be agreed. For example, the parties might agree by way of settlement a donation to charity or another gesture of goodwill which a Court could not order. Mediation is confidential and tends to be much quicker and cost effective than going to Court.
