Possession Claims

Possession Claims

We are experienced in acting for Landlords who find themselves faced with a problem tenant.  It may be that the tenant has not paid their rent or has breached the terms of the tenancy agreement in some other way, or it may be that the tenant has failed to leave the property after being served with a notice to quit. Whatever the circumstances, we can advise you on the fastest way to regain possession of your property, and take the swift action needed to do so.

In most circumstances, we are able to do all of the work involved on a fixed fee basis, we can even break the fixed fee into stages, to adjust to the individual needs of your case.

Stage 1

We will prepare and serve the appropriate notice upon your tenant, for a fixed fee of £125+VAT. In many cases the tenant will vacate the property at this stage.

Stage 2

If the tenant does not vacate the property after receipt of the Stage 1 notice, we will prepare a claim for possession of the property and file it with the court; our fee for Stage 2 will be between £550-£675 +VAT*. This fee also includes our work in preparing a witness statement and attending the court hearing on your behalf; in most cases the court will order that the tenant leave the property within 14 days.

If the tenant does not leave the property by the date ordered by the court, we will arrange for a bailiff to attend the property and evict the tenant.

We know that regaining possession of the property as quickly as possible is a Landlord’s number one priority, however, if the court makes an order for the tenant to pay any unpaid rent, or the legal fees for the possession proceedings, we will also advise you on the next steps and best methods to recover the money owed to you.

Why choose Gotelee?

In addition to our competitive fees, we are committed to providing our clients with an outstanding level of service. Please find below a testimonial from one of our Ipswich Landlord clients.
“I had a problem tenant who refused to leave the property at the end of the tenancy. I was able to promptly arrange a meeting with Holly who immediately identified the action to be taken, and swiftly issued proceedings to evict the tenant. Holly was at the end of the phone to answer my questions during the process and I found that very reassuring. I was happy and relieved to have my property back, following the successful conclusion of the case”  John Abbott, Ipswich.

Not only do we have extensive experience in acting for local Landlords in Ipswich and Suffolk, but we are able to tailor our service to Landlords with properties throughout England and Wales, at no extra cost.

* Excluding the relevant court fee, which will be advised at the time of instruction.
