The issue

Landmark Supreme Court ruling confirmed that the introduction of Employment Tribunal fees in 2013 was unlawful.  The imposition of unlawful tribunal fees had lead to a 70% reduction in the number of claims that were made by employees.  As a result, it is likely that the number of claims brought will increase again.  Employment Tribunal claims are disruptive, potentially costly, and can lead to adverse publicity. So, what can you do to prevent a claim being made against your business?

The problem areas are usually:

  • Having up to date employment contracts, policies and procedures is vital if you are to avoid successful claims – the law moves on quickly, but have your employment documents followed suit?
  • Having managers who understand why the policies need to be followed, and how to manage disputes in the workplace is also critical in avoiding claims – what training have you given to your managers?
  • To avoid claims arising, the best advice is to take early specialist employment law advice, to avoid costly claims – but does it get you to where you commercially need to be and are you worried about the cost?
