Our client was injured at hospital during a biopsy on a lump in the neck, causing damage to vocal chords
As a result, the client was left with speech, respiratory and swallowing problems.
Following an initial letter of claim, the NHS denied liability. Court proceedings were issued and served on the hospital.
The NHS filed a defence reiterating their denial of liability, stating the treatment had not been carried out negligently.
However, we obtained medical advice from experts in the field and continued to pursue the claim. We also gathered witness statements from the client, their family and work colleagues setting out the effects on the client’s working and home life.
Our lawyers gathered a detailed list of documents and accounts, as the client was self-employed and, as a result of the hospital’s negligence, had a reduced working and earnings capacity.
Following disclosure of all of the information to the defendants, a settlement was agreed, which involved a substantial sum in damages being paid to the client plus our costs.
