Occasionally, mistakes are made - and when they are, patients have a right to seek compensation.
An elderly man who had suffered a stroke was left waiting in A&E before being misdiagnosed and sent home.
He had suffered a disturbance to his vision and was told by his optician, who suspected he had suffered a stroke, to go to hospital. The optician rang ahead and sent the man with a letter.
However, the client was not seen in A&E for some time and appropriate tests were not carried out. He was eventually misdiagnosed, given a prescription and discharged.
It was not until a week later that he was seen by the stroke clinic after intervention by his GP, where he was diagnosed as having had a stroke and suffering permanent damage to his sight.
The hospital denied liability on the basis that the diagnosis by the hospital had been a reasonable one and that, in any event, the damage caused by the delay in diagnosis and treatment was minimal as compared to the damage caused by the stroke. Court proceedings were issued and served.
Sadly, the client died shortly after of completely unrelated problems. However, we were able to reach a settlement with the NHS on behalf of the client’s estate who took over the claim with the NHS paying damages to the estate and costs.
