New sentencing guidelines for dangerous and careless driving offences

Earlier this year, the Ministry of Justice consulted on the creation of a new offence of causing serious injury by careless driving. It also consulted on increasing the sentencing powers to a maximum of life imprisonment for causing death by dangerous driving and the separate offence of causing death by careless driving whilst under the influence of drink or drugs.

The government has considered the weight of responses which were in favour of the new offence and the increase in sentencing powers and will introduce this change to the law as soon as there is parliamentary time to do so.

The new offence will be used in those cases where serious injury has been caused by a driver whose driving fell below the standard of a careful and competent driver but did not fall far below that standard, which would have made them guilty of dangerous driving. Read more info on this here.
