Flexible Working and Time Off for Dependants – individuals

Flexible working

You have the right to request to work flexibly if you have a child under 17 years old (or 18 years old if your child is disabled) and you are or are going to be responsible for their upbringing or care. The same right applies if you care, or need to care, for an older dependant – for example an elderly relative.

You do not have a right to insist on changes being made to your hours of work or where you work – only to request that those changes are formally considered.  Your employer can only refuse a request on certain permitted grounds, and even if they do this, it is still possible that the decision could discriminate against you.

Time off for dependants

You are entitled to reasonable unpaid time off work to deal with an emergency situation involving a dependant (for example, if a child or relative falls ill or is injured, if care arrangements unexpectedly break down, or to arrange or attend a dependant’s funeral).

If you need to take emergency leave, it is important that you let your employer know and get it authorised before you leave. If there is simply no time to do this, you should let your employer know as soon as possible.
