Maternity and Adoption Leave – FAQs

Listed below are questions we are commonly asked:

I am on maternity leave and wish to return to work early. Can I?

Yes, but you must give your employer at least eight weeks’ notice of the revised date. Your employer may agree to you returning on shorter notice, but isn’t required to, if you haven’t given enough notice.

I’ve just found out I’m pregnant, what do I need to tell my employer?

Your employer will no doubt have a policy that sets out what you need to do.  In brief, you need to tell your employer (as soon as possible):

• That you are pregnant
• When you expect to give birth (which your midwife or doctor will be able to tell you); and
• when you would like your maternity leave to start (this cannot be more than 11^th weeks before the birth)

Whilst you don’t have to put this in writing, it is advisable to do so.

You should also provide a certificate from your doctor or midwife (a MAT B1).
