How long do I have to have worked for my employer before I can bring a claim?

In the vast majority of cases you need to have worked for your employer for at least one year in order to bring a claim for unfair dismissal. There are however circumstances in which this will not be the case so it is important to take legal advice.

What is the time limit for bringing a claim?

You must submit your claim in the Employment Tribunal within 3 months of the effective date of termination. This will normally be the last day you worked but this is not necessarily the case. In limited circumstances a Tribunal may extend the time-limit for bringing a claim, but this is never guaranteed, so always take advice from our employment solicitors as soon as you can.
