The Mesothelioma Act 2014

Under the Mesothelioma Act 2014, mesothelioma sufferers diagnosed on or after 25 July 2012 and who cannot trace a former employer or insurance company and who have not already received compensation will be eligible for compensation providing they can prove negligent exposure.  If successful a claimant will receive 75% of the average Court award for mesothelioma claims. In addition legal costs are expected to be fixed at a maximum £7,000 (including VAT) and it is anticipated that these legal costs will be included in the total sum of compensation paid to the claimant.

Due to the long period between exposure and the development of the condition, it can be difficult for mesothelioma sufferers to trace a former employer (or their insurance company) who exposed them to asbestos. After much lobbying the Government has finally recognised this problem and this led to the passing of the Mesothelioma Act 2014 on 31 January 2014 and created a compensation scheme with payments being funded by a levy on insurance companies.
To be eligible to make a claim under the 2014 Scheme sufferers of mesothelioma have to have been diagnosed on or after 25 July 2012 and cannot trace a former employer or that employer’s insurer and who have not already received compensation will be eligible, providing they can prove negligent exposure.
