The Mesothelioma Act 2014 aims to compensate victims who are unable to trace the employer who exposed them to asbestos dust or their employer’s liability insurers.
The legislation established a payment scheme for those who were diagnosed with the disease on or after 25 July 2012 and have not already received compensation, providing they can prove negligent exposure.
Due to the long period between exposure and the development of the condition, it can be difficult for sufferers to track down a former employer or their insurance company. After a lengthy campaign, the Government finally recognised the problem and introduced the scheme, with payments funded by a levy on insurance companies.
If successful, a claimant will receive compensation based on the average court award for mesothelioma claims. The amount paid is dependent upon the age of the claimant. The award made also includes a contribution of £7,000 (including VAT) towards a claimant’s legal costs.
