Regardless of the size of your workforce, you should have an Equal Opportunities policy and train your staff on equality and diversity in the workplace. It is important for your employees’ to understand how discrimination can arise in the workplace and that it will not be tolerated. It is also important for employees to understand what they can do if they feel that they are being discriminated against.
Even if your employees get on well together, dispute or situations can arise and you are ultimately liable for any discriminatory acts of your employees. In certain situations, a defence may be available if you have taken reasonable steps to ensure that discrimination does not occur in the workplace. If you don’t have an Equal Opportunities policy and you have not trained your employees, it is unlikely that you could rely on this defence.
