Listed below are questions we are commonly asked.
Employers that only carry out checks on prospective employees who appear to be of non-British descent risk claims of discrimination. For this reason, you should carry out the checks on all prospective employees.
The Home Office has issued a code of practice on avoiding race discrimination in recruitment which can be viewed on their website www.ukba.homeoffice.gov.uk. Failure to observe the code may be taken into account by an Employment Tribunal in deciding whether there has been discrimination.
